Siden 26. august har 295 produsenter mottatt MDO-er for mer enn 1 089 000 produkter. Siden fristen 9. september for å fjerne uautoriserte produkter fra markedet, har ikke FDA Tobacco Products Center autorisert noen e-sigarettprodukter for markedsføring. Produkter avvist av PMTA bør fjernes fra markedet eller gjenstand for ytterligere håndhevelse av FDA.FDA uttalte at dens høyeste håndhevelsesprioriteter inkluderer produkter som har mottatt MDO eller aldri har blitt sendt inn for vurdering.
